A major distinction relevant to the legal and regulatory regime applicable to the marketing of hedge funds in Bermuda is whether the vehicle in question is established in a foreign jurisdiction outside Bermuda (a “Foreign Fund”) or is incorporated and established in Bermuda (“a Bermuda Fund”). This article, for the most part, outlines the legal and regulatory regime applicable to the marketing of Foreign Funds in Bermuda although there is also a brief discussion on the marketing of Bermuda Funds in the jurisdiction.
