Asia Seminars: Bermuda to the fore for insolvency and restructuring

Multi-jurisdictional law firm Conyers Dill & Pearman hosted a series of seminars across South East Asia earlier this year. Director, Robin Mayor, discussed issues of insolvency and restructuring in Bermuda with large audiences of lawyers, insolvency practitioners and other professional advisors in the region.

Invitation-only seminars were hosted in Hong Kong, Singapore and Kuala Lumpur, which focused on challenges facing international companies who are facing financial difficulties – an issue which is of considerable interest in light of the recent economic challenges facing businesses.

Attendees were particularly interested in discussing how out of court restructurings of offshore vehicles across borders can be managed, as well as the relationship between the winding up of offshore companies in local courts (such as Hong Kong) and winding up in the place of incorporation (such as Bermuda). Recent cases regarding recognition of foreign insolvencies and restructurings were of particular interest. A number of attendees also queried the means available to obtain information in respect of offshore companies to assist in following assets into a Bermuda company.
